Terms of Service

Effective Date: July 7, 2026

These Terms of Service ("Terms") constitute a legally binding contract between you ("User," "you") and Machan AI ("we," "us," "our," or the "Platform"). These Terms govern your access to and use of the Machan AI web application, APIs, and associated services. By registering for an account, utilizing "Guest Mode," or otherwise accessing the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

1. Service Overview & Architecture

Machan AI is a sophisticated AI copilot interface aggregating various Large Language Models (LLMs), image generation APIs, web scraping tools, and computational integrations. We act solely as a conduit and user-interface layer between you and third-party infrastructural providers (e.g., Google, Anthropic, Hugging Face, Puter.js, Nvidia). We do not train, own, or control the underlying foundational AI models.

2. Account Registration, Verification, & Security

To unlock persistent storage and bypass Guest limitations, users must register for an account.

  • Account Responsibility: You are strictly and solely responsible for all activities executed under your credentials. You agree to notify us immediately of any security breach.
  • Mandatory Verification Protocol: Machan AI requires all registered users to verify their email addresses. A strict 7-day grace period applies upon registration. Failure to verify within this window will trigger automated account suspension until verification is complete.
  • Guest Mode Usage: We offer a highly restricted "Guest Mode" for trial purposes. Guest users possess no guarantee of service stability, face severe rate limits, and have no right to data persistence. We reserve the right to block Guest access from specific IPs to protect our infrastructure.

3. Acceptable Use Policy (AUP)

You agree to utilize Machan AI strictly for lawful, ethical purposes. You expressly agree NOT to use the Platform to:

  • Generate, request, or disseminate Child Sexual Abuse Material (CSAM), non-consensual explicit imagery, or extreme violence.
  • Promote hate speech, self-harm, terrorism, or illegal acts.
  • Generate, refine, or deploy malware, ransomware, or execute automated cyberattacks.
  • Attempt to jailbreak, prompt-inject, reverse-engineer, DDoS, or systematically bypass the safety filters, rate limits, or billing mechanisms of our Platform or our underlying AI providers.
  • Upload files containing malicious executables into the Machan AI Library/Ceyon CDN.

Enforcement: We maintain a zero-tolerance policy for AUP violations. Breaches will result in immediate, permanent account termination, IP blacklisting, and, where applicable, reporting to relevant law enforcement agencies.

4. Intellectual Property & Content Ownership

Your Input (Prompts & Files): You retain all pre-existing intellectual property rights to the text and files you input into the Service. By interacting with the Platform, you grant us a limited, worldwide, royalty-free, non-exclusive license to host, transmit, and process your inputs solely to generate your requested outputs.

AI Output (Generated Content): To the maximum extent permitted by applicable law, you retain commercial and personal usage rights to the outputs (text, code, images) generated by the AI as a result of your prompts. However, you acknowledge that AI-generated content may lack copyright eligibility in certain jurisdictions, and identical or similar outputs may be generated for other users based on similar prompts. We make no representations regarding the copyrightability of AI output.

5. Fair Usage, Quotas, & API Limitations

Machan AI provides robust free access to premium models; however, to maintain infrastructural integrity, hard limitations apply:

  • Library Quotas: Each registered user is allocated a maximum of 128 MB of cloud storage on the Ceyon CDN for document and image retention. Reaching this limit requires manual deletion of older files to proceed.
  • File Attachments: A strict maximum of 10 files may be attached to a single AI prompt.
  • Rate Limiting & Availability: We, alongside our upstream providers (Google, Puter), enforce dynamic API rate limits. High-frequency requests will trigger temporary cooling-off periods (HTTP 429). The Platform does not guarantee 100% uptime for any specific AI model.

6. Artificial Intelligence & Data Disclaimers

You explicitly acknowledge and accept the inherent limitations of Generative AI technology:

  • Hallucinations & Factuality: AI models generate responses based on statistical probability. They frequently produce information that is factually incorrect, logically flawed, or entirely fabricated. Machan AI does not guarantee the accuracy, completeness, or reliability of any AI output.
  • Live Data Constraints (Finance & Weather): Financial tickers, exchange rates, and weather forecasts provided by the AI are fetched from free, third-party APIs. This data may be delayed, inaccurate, or incomplete. You must not execute financial trades or make critical real-world decisions based on Machan AI outputs.
  • No Professional Advice: The Platform is not a licensed professional. You must never rely on the Service for medical diagnoses, legal counsel, financial investments, or safety-critical engineering decisions.

7. Third-Party Integrations & External Execution

Puter.js Billing & Limits: Certain premium models within the Platform (e.g., Claude, DeepSeek, Llama) are routed via Puter.js. These are subject to Puter's "User-Pays" network. Machan AI is not responsible for any billing, low-balance errors, or account issues associated with your external Puter account.

Code Execution Sandbox: The Service includes an HTML/CSS/JS previewer ("Run Preview"). Code executed in this iframe is generated by AI. You execute generated code entirely at your own risk. Machan AI assumes zero liability for browser crashes, data loss, or malicious client-side execution resulting from viewing AI-generated code.

Google Drive OAuth: If you connect Google Drive, you do so subject to Google's Terms of Service. We are not liable for access interruptions caused by Google API changes.

8. Limitation of Liability, Disclaimers, & Indemnification

DISCLAIMER OF WARRANTIES: MACHAN AI IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MACHAN AI, ITS CREATORS, DEVELOPERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

INDEMNIFICATION: You agree to defend, indemnify, and hold harmless Machan AI and its developer from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of and access to the Service, or your violation of these Terms.

9. Governing Law, Dispute Resolution & Termination

Governing Law: These Terms shall be governed by and construed in accordance with the laws of Sri Lanka, without regard to its conflict of law provisions.

Termination: We reserve the right to suspend, restrict, or permanently terminate your account and access to the Service at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

10. Changes to Terms

We reserve the unilateral right to modify or replace these Terms at any time. Material changes will be updated on this page with a new Effective Date. Your continued use of the Platform after any revisions become effective constitutes your binding acceptance of the revised Terms.
